INTRODUCTION
The acceptance of this contractual document, which will govern the purchase of products through the website, https://www.florespana.es/, implies that the user has read and understood what is outlined herein. It also confirms that the user has the necessary capacity to contract, assuming all obligations set forth in this document. Likewise, the provider reserves the right to modify the terms of use of the website without affecting goods or promotions previously acquired prior to such modification. Therefore, it is the user's responsibility to read these periodically, as the conditions in force at the time of using the website or entering into the contract will be the applicable ones.
IDENTITY OF THE PARTIES
On one hand, the entity or brand: FLORESPAÑA and the website www.florespana.es, domiciled at Calle de Borrull 32-1, 46008 Valencia, Spain. The personal data provided by visitors will be processed in accordance with the Privacy Policy available on the website https://www.florespana.es. By using our website, the user is responsible for the accuracy of the information provided about themselves.
PURPOSE OF THE CONTRACT
This document will regulate the contractual relationship of sale established between the provider (florespana.es) and the user (You) at the moment when the user accepts, during the online purchasing process, the relevant box. The contractual relationship involves the delivery, in exchange for a specified and publicly displayed price on the website, of a specific product or service.
PURCHASING PROCEDURE
The purchasing process can only be carried out in English and/or Spanish. If it can be conducted in any other language, this will be indicated prior to starting the purchasing process. Placing an order implies full and unconditional acceptance of the general sales conditions. Therefore, the buyer will not impose conditions contrary to the seller's unless explicitly accepted, regardless of when they are brought to their attention. In accordance with Article 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the steps for the purchase process are as follows:
1. Order Processing: After completing the selection of items, you will proceed to the order confirmation section. Here, you will be asked to identify yourself. This confirmation makes the agreement between the parties effective.
2. Customer Registration: The customer registers by filling out a form with personal and payment details, creating a username and password. The user agrees to use these diligently and not to share them with third parties, as well as to inform us of any loss, theft, or unauthorized access so that the platform can be blocked immediately.
3. Shopping Cart: The items you wish to purchase must be selected and added to the cart by clicking the corresponding icon. Upon completing the purchase process, the platform will email you with all the details, including characteristics, price, shipping options, purchase date, and estimated delivery date.
4. Availability and Stock: Products displayed on the website are offered in real-time, meaning they are available in our warehouses and those of our suppliers. If a product is out of stock, the customer can request it via WhatsApp or by emailing info@florespana.es. If the customer has already paid and stock is unavailable for delivery within 15 working days, the order will be canceled, and the full amount paid will be refunded. Due to the nature of natural plants, these may vary slightly in shape, size, and colour in real-time. Florespaña will contact the buyer (within a maximum of 72 hours after the order is placed) to inform about any minor variation or available alternative and to obtain approval to proceed with the order.
5. Packaging and Shipping: Products sent via courier are carefully packed into sturdy cardboard boxes. Large volume products (over 155cm) are shipped without a cardboard box.
SHIPPING AND DELIVERY OF ORDERS
- From the moment the order is placed, the buyer will receive an order confirmation, and within a maximum of 48 hours on working days, a shipping confirmation with the estimated delivery timeframe.
- There will be a maximum of 2 delivery attempts by the courier company (contracted by FLORESPAÑA) to the provided address. The shipment will be held at a pickup point or office for up to 8 days (SEUR, SENDING) or 15 days (CORREOS and CORREOS EXPRESS) before being returned to the sender.
- FLORESPAÑA is not responsible if delivery fails due to incorrect, false, or incomplete data provided by the user or due to causes beyond the courier’s control, such as the absence of the recipient or customs hold.
- Delivery times are approximate; FLORESPAÑA always tries to adhere to them.
- No specific date or time is agreed upon for online orders, except in exceptional cases where FLORESPAÑA communicates such details explicitly.
- If there are delays due to logistical issues, weather conditions, supplier availability, or public holidays, FLORESPAÑA will contact the buyer to inform them and provide a new estimated delivery date.
DIMENSIONS AND SPECIFICATIONS OF PLANTS ON THE WEBSITE
- Plant dimensions are always approximate, based on the product description. As natural products, no two are identical. Height measurements are from the base of the pot to the highest point of the plant, and for hanging plants, Calatheas, Strelitzias, and other variable-height plants, measurements are from the base to the longest leaf or stem.
- Terms mentioned in "the URL name of the product" are non-binding; only the specifications in the order confirmation summary are binding.
- If the product specifications do not match what is indicated online and the customer has given written agreement (via email or WhatsApp) regarding the offered alternative, the communicated data will be considered the only valid ones.
PRICE AND VALIDITY PERIOD OF THE OFFER
- Prices for each product are in euros and include legally applicable VAT. Unless otherwise specified, they also include shipping, handling, wrapping, insurance, and any additional services or related costs.
- Prices shown on the website are applied automatically during the final stage of the purchase process. Prices may vary in real-time; such changes will be communicated to users beforehand. If a pricing error is detected, we will inform you as soon as possible to reconfirm or cancel the order.
PAYMENT METHODS AND ORDER EXECUTION
- Payments are accepted only via credit/debit card (Visa, Visa Electron, MasterCard), Klarna, PayPal, or Bank Transfer.
- All payments made will generate an invoice in the name of the registered user, which will be sent automatically to the email address provided and included with the purchased product.
- Product availability may vary depending on demand. If the product is unavailable, FLORESPAÑA will notify the customer via email within a maximum of 7 days.
- Orders cannot be executed if the product is out of stock; in such cases, the customer will be informed.
RIGHT OF WITHDRAWAL FOR PLANTS AND NATURAL FLOWERS
- According to Article 103 of Law 3/2014, of 27 March, which modifies the Consolidated Text of the General Law for the Defence of Consumers and Users, supplies of services or goods customised according to consumer specifications, clearly personalised, or that, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.
RETURNS AND REPLACEMENTS FOR PLANTS AND NATURAL FLOWERS
If the delivered item(s) do not meet expectations, FLORESPAÑA commits to replacing the product with a new one if:
- The sent product is incorrect and does not match the order.
- The quantity does not match the order.
- The product arrives damaged. For minor damages, a related amount will be offered.
- FLORESPAÑA will cover the costs of the new shipment.
- Contact us within 48 hours of receipt by emailing info@florespana.es or WhatsApp at 603 30 45 11, attaching photos clearly showing damage or incorrect items, along with the order number.
- If natural plants are left at a collection point and not retrieved within 72 hours of delivery, FLORESPAÑA will not be responsible for any damage or loss.
- After 72 hours from delivery, FLORESPAÑA is not responsible for any damage to the delivered plants.
- Under no circumstances does the right of withdrawal apply to natural plants and flowers.
- FLORESPAÑA reserves the right to evaluate each case and request additional information or evidence from the courier, supplier, or recipient. This evaluation may take a maximum of 7 working days.
WARRANTY OF CONFORMITY AND RETURN FOR ARTIFICIAL PLANTS, POTS, TOOLS, AND FERTILISERS
Non-living items (e.g., artificial plants, pots, tools, fertilisers) must be delivered in the quantity, type, and quality specified in the contract, with the agreed packaging, accessories, instructions, and updates. If they do not meet the description, quality, or functionality as described online or on the delivery note, FLORESPAÑA will replace, discount, or repair the product after consultation and approval from the buyer.
- FLORESPAÑA will cover the costs of the return shipment.
RIGHT OF WITHDRAWAL FOR NON-NATURAL PRODUCTS
- Customers have up to fourteen (14) calendar days from receipt of the order to exercise their right of withdrawal without needing to specify a reason.
- Direct costs of returning will be borne by the customer; the amount paid for shipping (outward and return) will not be refunded.
- Returns are not accepted if the packaging or components are not in original condition or are damaged.
- The customer must ensure the product is properly protected and sealed for transport.
- FLORESPAÑA may retain the refund until the products are returned and may deduct from the refund amount if products are returned in poor condition, in accordance with applicable law.
- Once the returned goods are received and inspected, the refund will be processed within a maximum of 15 days.
FLORESPAÑA'S WARRANTY FOR PLANTS: 30 DAYS / 15 DAYS
- This is an additional quality guarantee for natural plants.
- Indoor plants are guaranteed to grow for 30 days, outdoor plants for 15 days from delivery to the specified address or point of collection.
- The customer must give FLORESPAÑA the opportunity to investigate the growth guarantee claim.
- If the claim is successful, FLORESPAÑA will send a replacement plant or refund the amount paid, or a proportion corresponding to the issue.
- The guarantee does not cover defects or damage caused by: a) reckless use; b) improper or lack of maintenance; c) overwatering or underwatering; d) damage from fire, lightning, floods, natural disasters, explosions, frost, or extreme weather; e) improper planting, pruning, or care. - To claim the guarantee, contact us at info@florespana.es or WhatsApp.
COOKIE POLICY
Florespana and/or third-party providers may use cookies when users browse the website. Cookies are files sent to the browser to record user activity during browsing. Cookies are associated only with an anonymous user and their device and do not directly provide personal data. Cookies help recognise the web browser, making browsing easier, and are used to measure audience and traffic parameters, control processes, and number of visits. Users can configure their browsers to be notified of cookie receipt and prevent their installation. Cookies are temporary and do not collect personal information.
APPLICABLE LAW AND JURISDICTION
Without prejudice to the parties' option to voluntarily submit disputes to the online dispute resolution system mentioned above, the relationship between the user and the provider will be governed by the current applicable Spanish legislation. Any disputes may be submitted to arbitration or taken to the ordinary courts, following relevant jurisdiction and competence rules, with submission to the consumer's domicile court.
